TERMS AND CONDITIONS FOR KAABAROOM

These Terms and Conditions govern your access to and use of the KaabaRoom website, booking platform, and related services. By using the Platform, creating an account, or submitting a booking, you agree to these Terms. If you do not agree, please do not use the Platform.
1. Company Information and Definitions
- "Company," "KaabaRoom," "we," "us," or "our" means KaabaRoom LLC, a Wyoming limited liability company registered with the Wyoming Secretary of State under Original ID 2026-002054046 on August 11, 2026. Its principal office is 1021 E Lincolnway, 10679, Cheyenne, WY 82001, United States.
- "Platform" means the KaabaRoom website and any related booking interfaces or digital services we operate.
- "User," "you," or "your" means any visitor, account holder, traveler, guest, or customer using the Platform.
- "Service Provider" means a hotel, accommodation provider, transport operator, tour operator, event organizer, airline, boat operator, visa-support provider, or other independent supplier whose service may be displayed or booked through the Platform.
- "Booking" means a reservation or service request submitted through the Platform and confirmed in accordance with these Terms.
2. Eligibility, Accounts, and Acceptable Use
- You must be at least 18 years old and legally capable of entering into a binding contract to make a Booking.
- You must provide accurate, current, and complete information and keep your account credentials confidential.
- You are responsible for activity performed through your account unless you promptly notify us of suspected unauthorized use.
- You must not misuse the Platform, attempt unauthorized access, interfere with its operation, submit fraudulent information, or use it for unlawful purposes.
3. KaabaRoom's Role and Service Providers
KaabaRoom operates a travel and booking platform. Unless a service is expressly identified as being supplied directly by KaabaRoom, the underlying travel service is provided by an independent Service Provider. The Service Provider remains responsible for delivering its service, maintaining required licenses or permits, and honoring the confirmed service terms. KaabaRoom facilitates discovery, communication, reservation, and payment where available.
Service descriptions, availability, ratings, images, amenities, and policies may be supplied by Service Providers. We take reasonable steps to present information accurately but cannot guarantee that supplier-provided information will always be complete or error-free. Material changes affecting a confirmed Booking will be communicated when known.
4. Booking and Contract Formation
- Submitting a Booking request is an offer to purchase the selected service at the displayed terms.
- A Booking becomes confirmed only when you receive a confirmation from KaabaRoom containing a reservation or booking reference.
- The confirmation, selected rate rules, supplier policies, and these Terms together form the applicable booking contract.
- Special requests, including room views, floor preferences, bedding, accessibility arrangements, or adjacent rooms, are subject to availability and are not guaranteed unless expressly confirmed in writing.
- You must review all names, dates, destinations, and service details before completing payment and promptly report any error.
5. Prices, Taxes, Fees, and Payments
- Prices are displayed in the currency shown on the checkout page. Saudi Riyals (SAR) may be used for services offered in Saudi Arabia.
- Applicable taxes, supplier charges, service fees, and other mandatory costs will be included in or itemized with the total presented before confirmation, as applicable.
- Available payment methods are those displayed at checkout and may vary by country, currency, service, or payment provider.
- Payments may be processed by independent payment service providers under their own terms and privacy notices. KaabaRoom does not require you to provide payment-card details outside the authorized checkout process.
- If a displayed price or availability is affected by an obvious technical or supplier error, we may request your approval of the corrected terms or cancel the affected request and refund amounts received for it.
6. Cancellations, Changes, Refunds, and No-Shows
- The cancellation, modification, and refund rules shown before purchase and in your confirmation apply to your Booking.
- Flexible and non-refundable rates may have different deadlines, penalties, and change restrictions. A rate identified as non-refundable may not be eligible for a voluntary refund except where mandatory law requires otherwise.
- Approved refunds are returned to the original payment method where practicable. Processing time depends on the Service Provider, payment processor, and financial institution.
- Failure to arrive or use a service without timely cancellation may be treated as a no-show and may result in charges up to the full Booking value, subject to the confirmed policy and applicable law.
- If a Service Provider cancels or cannot deliver a confirmed service, we will reasonably assist with an available alternative or a refund of the affected amount received by us, subject to applicable law and the circumstances.
7. Peak Seasons, Group Bookings, and Packages
- Rates, minimum stays, deposits, and cancellation conditions may be stricter during Ramadan, Hajj, public holidays, and other high-demand periods. The specific conditions displayed at checkout control.
- Bookings involving multiple rooms, large groups, or customized itineraries may require separate quotations, deposits, traveler lists, or supplier approval.
- A package includes only the items expressly listed in its description and confirmation. Services not listed are not included.
- Early departure or partial non-use does not automatically create a refund right and will be handled under the confirmed policy and mandatory law.
8. Travel Documents, Visas, and Local Requirements
- You are responsible for passports, identification, visas, permits, health requirements, entry eligibility, and compliance with government and destination rules.
- Any visa-related information or booking confirmation we provide is administrative assistance only and does not guarantee visa issuance, admission, or entry to any destination.
- Access to Makkah, holy sites, airports, hotels, events, and transport services may be restricted by applicable government rules and Service Provider requirements.
9. Privacy and Traveler Documentation
- Our collection and use of personal data are governed by the KaabaRoom Privacy Policy and applicable data-protection requirements.
- Where reasonably necessary to complete a Booking or satisfy a lawful supplier or authority requirement, we may request traveler information or identification documents. We will request only information reasonably required for the relevant purpose.
- Required information may be shared with the relevant Service Provider, payment provider, or competent authority when necessary to provide the service, comply with law, prevent fraud, or protect legal rights.
- Do not send passports, payment details, or other sensitive documents through unofficial channels. Use only the secure method identified by KaabaRoom for the specific Booking.
10. User and Guest Responsibilities
- You and accompanying travelers must comply with applicable laws, public-order requirements, health and safety instructions, and reasonable Service Provider rules.
- You are responsible for loss or damage caused intentionally or negligently by you or travelers included in your Booking.
- Service Providers may refuse or terminate service where permitted by law for dangerous, abusive, fraudulent, or unlawful conduct.
11. Availability, Force Majeure, and Liability
The Platform may occasionally be unavailable because of maintenance, communications failures, security events, or circumstances beyond our reasonable control. We do not guarantee uninterrupted access.
Neither KaabaRoom nor a Service Provider is responsible for delay or failure caused by events beyond reasonable control, including government restrictions, natural disasters, severe weather, epidemics, armed conflict, labor disruption, transport interruption, or failures of essential networks. The parties will handle affected Bookings in accordance with applicable law, supplier rules, and available remedies.
To the maximum extent permitted by applicable law, KaabaRoom is not liable for indirect, incidental, or consequential loss. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded or limited.
12. Intellectual Property
The Platform, KaabaRoom name, branding, software, design, and original content are owned by or licensed to KaabaRoom LLC and are protected by applicable intellectual-property laws. You may use the Platform only for personal and legitimate booking purposes. You may not copy, scrape, republish, sell, reverse engineer, or commercially exploit Platform content without authorization.
13. Suspension and Termination
We may restrict or suspend access where reasonably necessary to protect users, prevent fraud, comply with law, investigate misuse, or preserve Platform security. This does not affect rights or obligations relating to an existing confirmed Booking unless cancellation is permitted by its terms or applicable law.
14. Changes to These Terms
We may update these Terms to reflect legal, operational, or service changes. The updated version and effective date will be posted on the Platform. Changes will not retroactively reduce rights attached to a confirmed Booking unless required by law or agreed with you.
15. Governing Law and Disputes
The formation, governance, and internal affairs of KaabaRoom LLC are governed by the laws of the State of Wyoming, United States. Services and transactions provided to users remain subject to the mandatory laws applicable where the service is supplied or the consumer is located, including the laws of the Kingdom of Saudi Arabia where applicable.
Before commencing formal proceedings, you are encouraged to contact us so we can attempt to resolve the matter. Any unresolved dispute shall be submitted to a court or authority of competent jurisdiction as determined by applicable law. Nothing in these Terms limits any non-waivable consumer right or mandatory legal remedy.
16. General Provisions
If any provision is held invalid or unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer your rights under a Booking without our or the relevant Service Provider's consent where required. These Terms, the Booking confirmation, the selected rate rules, and incorporated policies constitute the agreement relating to the Booking.
